3.42Fine Policy2018-09-27

The Board of Directors has revised the fine policy as of September 27, 2018 to allow a 3 step process to be used. It is the intent of the Board that violations move through a three-step process of:

  1. Notice of Violation with Request to Correct,
  2. Notice of Violation with Intent to Fine,
  3. Notice of Violation with Fine Incurred.

The fine amount will be $50 for each violation. A citation is a violation notice issued for an instance of a new or a repeat violation. A violation type is the associated rule or provision from the Canyon Creek Restrictions that has been cited in the violation notice. A violation is considered cured when the board, in its sole discretion, determines the Member's property is in compliance with the Canyon Creek Restrictions. At the September 17, 2018 regular meeting of the Board, the new policy was unanimously adopted and became effective on September 27, 2018.

3.44Fine Policy2017-07-01

The Board of Directors has been considering revisions to the Association’s policy regarding fines for violations of the Canyon Creek Restrictions. The motivations for considering updates to the policy and the proposed revisions were discussed in a blog post on the Association’s website, www.canyoncreek.net on April 3, 2017 where the text of the revised policy draft was made available. At that time the Board of Directors invited Members to review the draft and to share any comments on the proposed changes at the next scheduled meeting of the Board of Directors on May 22, 2017.

At the May 22, 2017 regular meeting of the Board, the new policy was unanimously adopted and will become effective on July 1, 2017 subject to filing processes and notice periods under all applicable laws and our governing documents. The new policy and resolution are posted here.
